In response to such crisscrossing legal battles, New York Governor Kathy Hochul has reinforced protections for abortion providers through the expansion of the state's "shield law." This legislative measure aims to safeguard professionals like Dr. Carpenter from being penalized for providing services that are lawful in the state of New York but prohibited in other states.

The case underscores broader national conflicts as various states transition toward more restrictive or protective abortion laws. The Abortion Coalition for Telemedicine, co-founded by Dr. Carpenter, continues to strive for widespread abortion access, accommodating patients regardless of their state of residence. Legal experts anticipate that the friction between state laws could ultimately require intervention from the Supreme Court to resolve. The case also highlights the potential risks faced by healthcare providers who travel outside states where their practice is protected.



NY doctor charged in Louisiana for prescribing abortion pills

There is an abortion battle playing out between red states and blue states, and doctors are at the center of it. Dr. Margaret Carpenter here in New York, where abortion is legal, is facing a criminal charge in Louisiana. Her crime, prescribing abortion pills and shipping them to a woman in that state. As some states like Louisiana move to ban or restrict abortion since the overturning of Roe v. Wade, many women have turned to telemedicine and out-of-state doctors to ship abortion pills directly to them. In this case, Louisiana officials are trying to extradite Dr. Carpenter to face punishment. But New York's governor, Kathy Hochul, recently passed an expansion of SHIELD laws protecting abortion providers. I spoke with the governor about what comes next. The Supreme Court may have to get involved in resolving a dispute between two states' interpretation. Do you expect this case to go to the Supreme Court? I expect that I will stand firm to protect this doctor, so she's staying right here. In the wake of Roe v. Wade being overturned, Dr. Carpenter co-founded the Abortion Coalition for Telemedicine to try to make abortion care available to patients in all 50 states. One of her co-founders, Julie F. Kaye, is a human rights attorney who successfully argued against Ireland's ban on abortion. And Julie F. Kaye joins us this morning. Good morning to you. Good morning. First and foremost, how is Dr. Carpenter doing, if you can give us a sense of just sort of her state of mind? Nobody becomes an abortion provider in America unless they're really dedicated to serving women and patients. And Dr. Carpenter has been a licensed practitioner for decades, and she continues the mission that she started out to, of providing safe, licensed care, no matter where somebody lives, and making sure that they get abortion access with dignity and safety. And if you could start off by explaining to our viewers, too, how does this work when you think about telemedicine and getting those pills to have that type of care, no matter what state you live in? Well, telemedicine is really the modern house call, we call it. And we all use telemedicine to talk to our pediatricians, to our dermatologists. It's similar with telemedicine abortion. There's a screening process done by a licensed practitioner to identify if there are any concerns. There's a little bit of back and forth with the patient, if there are, to make sure this is the right treatment and appropriate. And then the licensed practitioner sends FDA-certified medications, depending on what level the patient can afford. The pills arrive within three to five days. They're standard medications, and within 48 hours, the person can have an abortion within their own home. As you know, within this case, the Louisiana DA that I spoke to said that the pills actually went to a minor, that it was her mother who ordered these pills. And they said it's illegal, as you know, in that state of Louisiana. So the question I have for you is, do you feel like the screening process should be changed in any way when you hear the DA saying that this was actually for a minor? Louisiana is reaching out of its state to try to stop abortion nationwide. And so as we learn more about the facts of this case, we'll learn more about why this is a safe and legal and effective method of abortion that over a fifth of Americans are using now to get access to care. And we should be looking at, if anything in Louisiana, why isn't care available there? Why is the maternal mortality rate so horrific? Why are we looking at women having to travel or to use outside of state care, even in cases of rape or incest or when their lives are seriously at risk? Julie, I just want to know if Dr. Carpenter, we understand that Dr. Carpenter is protected here in New York State. What happens if she chooses to travel out of state? And I don't even mean Louisiana, I just mean leaves the boundaries, the borders of New York State. Well, this goes back to the life of an abortion provider, and we saw this even when Roe was law of the land. There's a lot of threats against doctors who are choosing to provide reproductive health care. And so, you know, we are concerned. There's a lot of safety and protection for Dr. Carpenter, but there's also a lot of people that support what she's doing. 70% of Americans want abortion to be available under the Roe versus Wade framework, and we've seen a tremendous amount of support for access to safe and legal telemedicine care, as well as the wide range of doctors who are providing it. But I mean, she wouldn't be arrested if she left New York State, if she went to another state. She could be. She could be arrested? Her name's in a national database. That's the question. Governor Hochul has stood up loudly and strongly about protecting Dr. Carpenter within states, and we're looking for others to do the same. And everyone who cares about abortion rights should have the backs of the providers who are making care available to patients who would otherwise have no access or very limited access without travel. Do you think this case could go to the Supreme Court, and how is your organization preparing for that next potential chapter? We expect that this or some other case will go to the Supreme Court. I always refer back to the marriage equality when Massachusetts had same-sex marriage, but Texas considered sodomy a crime. That worked its way up to the Supreme Court, who said there's a right to marry who you love in this country. And we expect that this case, because of the difference in state laws, unless either the state of Louisiana or the state of Texas decides enough, we don't want our prosecutors doing this. We don't want our law enforcement officials trying to ban abortion nationwide, and they drop those cases, which we would welcome. But if not, we're going to keep fighting it. Julie F.
