Patterson is currently serving a life sentence with a non-parole period of 33 years. The Office of Public Prosecutions is also considering an appeal, potentially arguing that the sentence was too lenient.

Defence Barrister Richard Edney joined Patterson's team of solicitors, replacing Colin Mandy, the man who took Patterson through her mammoth 11-week trial. Justice Christopher Beale noted applications for extension of time to the Court of Appeal are routinely granted if the extension is for an additional 28 days. Given the length of this trial, the applicant is wanting to take advantage of that extension of time. If they have a new barrister, which they do, they will have fresh eyes and try and determine whether there was an error that caused a substantial miscarriage of justice. Patterson celebrated her 51st birthday this week, her first since being sentenced. Given life behind bars with a non-parole period of 33 years, she won't be eligible for a lease until after her 82nd birthday, unless her appeal is successful. If they succeed, the court would most likely order a retrial and they would have to start all over again. Last month, the Office of Public Prosecutions indicated it too was considering an appeal of Erin Patterson's sentence. If it chooses to take that route, it would take the opposing argument that her sentence was manifestly inadequate. An extension will push out Patterson's appeal deadline to November 4.
