In Chicago, a federal judge is considering the need for troops in response to violent protests, while a panel in Oregon is reviewing whether the president exceeded his authority by ordering troops to Portland. 

Approximately 200 Texas Guard members are already present in the Chicago area, with additional personnel in training or assisting. In Oregon, troop deployment remains on hold due to a federal judge's order, though some judges appear open to lifting this restriction. The president has also raised the possibility of invoking the Insurrection Act, a rarely used law that allows domestic military deployment under specific circumstances, though local lawmakers argue such conditions have not been met.

Where does the deployment of National Guard troops stand?

In Chicago, a federal judge considered whether President Trump is accurate when he claims that troops are needed to address violent protests in the city. Meanwhile, a three-judge panel took on the question of whether the president exceeded his authority by ordering troops to go to Portland, Oregon. And as these cases are playing out, authorities in Memphis, Tennessee, say the National Guard will begin patrolling the streets tomorrow. CBS News Homeland Security correspondent, Nicole Skanga, joins us now. So, Nicole, zoom out to 30,000 feet for me. Where does the deployment of the National Guard troops stand right now? Yeah. Kelly, good to be with you. About 200 Texas Guard members already on the ground in the Chicago area. And new information here, 20 already stationed at that Broadview ICE facility as missions quietly get underway. Meanwhile, 300 members of the Illinois National Guard are still in pre-mission training and processing and have not yet been deployed. But sources also telling CBS News roughly 20 members of California's National Guard assisting with that training, the same team that our viewers might remember supported federal operations in Los Angeles earlier this summer. As for Oregon, troops are still in a holding pattern after an order from a federal judge barred the Trump administration from sending them there. But you mentioned some of these ongoing court hearings. At least two of the three panel judge today in Oregon seemed open to lifting that order. During that 73-minute hearing, they had a lot of questions about the lower court's decision to restrict President Trump's assessment of conditions in Portland. So we could see more National Guard members there in the coming days. Yeah, a lot hanging in the balance there. And just everything is changing so rapidly. Something perked my ears earlier this week. I mean, the president raised the possibility of invoking the Insurrection Act. So what exactly would that mean? Where could he utilize it? Yeah, a bit of a history lesson here, Kelly. That would be a major escalation. The Insurrection Act is a federal law that allows the president to deploy military forces domestically in very, very limited circumstances to suppress insurrections, rebellions or when ordinary law enforcement can't enforce federal law. And it's been invoked just over a dozen times over the past century. And it can be viewed as a political third rail because of how drastic the measure is, deploying troops to police American cities, granting soldiers the power to carry out arrests. Generally give the president significant discretion under the act. But of course, already in response to what the president suggested, lawmakers in Oregon and Illinois have argued there's no evidence of insurrection or rebellion in these cities and no need to invoke that act.
