Washington County Sheriff Marty Shultey has clarified the county's collaboration agreement with U.S. Immigration and Customs Enforcement (ICE), which was signed seven months prior. The sheriff emphasized that while the agreement is new, the practice of honoring ICE detainers has been in place since 2012. The agreement allows a select group of jail sergeants, credentialed as immigration agents, to serve administrative warrants for inmates who have committed crimes and are not in the country legally.

Shultey noted that the agreement applies only within the jail and does not affect individuals seeking emergency services. He addressed concerns raised by the American Civil Liberties Union (ACLU), which warned of potential legal and financial risks and criticized the broader impact of such agreements. The sheriff believes the new agreement reduces liability for the county, while the ACLU maintains its opposition, citing concerns about the 'jail to deportation pipeline.'

THE SHERIFF SAYS THE AGREEMENT IS NEW, BUT THE POLICY IS NOT. 13 county sheriff's offices in Wisconsin have similar agreements. The warrant service officer program he signed specifically allows his office to serve and execute administrative warrants, meaning hold people on immigration detainer if any inmate in his county jail has committed a crime and is not in the country legally. We have a select group of our jail sergeants that are credentialed and sworn as immigration agents with the sole authority just to issue those administrative warrants. SHULTEY SHARED THIS 2018 LETTER TO THE PREVIOUS SHERIFF FROM THE AMERICAN CIVIL LIBERTIES UNION WARNING THE COUNTY, QUOTE, HOLDING PEOPLE BASED ON ICE DETAINERS EXPOSES YOU TO RISK OF STEEP FINANCIAL LIABILITY AND PROTRACTED LITIGATION. THE LETTER ALSO RAISED CONCERNS AT THAT TIME ABOUT, QUOTE, THE TRUMP ADMINISTRATION'S INCREASINGLY INHUMANE DEPORTATION POLICIES. SHULTEY BELIEVES THE NEW AGREEMENTS CREATED UNDER THE TRUMP ADMINISTRATION REDUCE ANY POTENTIAL LIABILITY TO THE COUNTY. We have a daily population of maybe about 230, 240 individuals, and we're holding six individuals today on ice detainers, meaning that they're still serving their state sentences here. He says all six are in jail on felony charges. The 10-page agreement requires his staff to be trained and certified. He stresses the collaboration agreement with ICE is for only inside the jail, and not with anyone who calls or needs emergency services in the county. My fear is that it became such a hot topic, is that you might have individuals that need law enforcement assistance, medical assistance, fire assistance, that they're hesitant to reach out for that service for fear that they'll be tamed on the sole basis of being here legally. The ACLU tells me it also opposes these new agreements, saying they contribute to quote the jail to deportation pipeline back to you.
