A judge in New York has dismissed the most serious state terrorism-related charges against Luigi Mangione, who is accused of killing UnitedHealthcare CEO Brian Thompson. The prosecution had argued that Mangione aimed to incite public fear, but the court found insufficient evidence to support the terrorism charges. 

Mangione continues to face nine other charges, including second-degree murder, multiple gun-related offenses, and possession of a forged ID. A separate federal case is also underway, with prosecutors seeking the death penalty. The next hearings in both state and federal cases are scheduled, with further rulings expected on the admissibility of key evidence.

All right, another big case on the docket. The man accused of killing UnitedHealthcare CEO Brian Thompson just appeared in state court here in New York City for a pre-trial hearing. Luigi Mangione is facing both state and federal charges. And you may remember, Brian Thompson was gunned down on a New York City street in what police called a targeted killing. Mangione was then arrested in Pennsylvania, I think about five days later after a wide manhunt. CBS News Senior Coordinating Producer for Crime and Public Safety Anna Schecter is here with us, I remember going back and we were wondering where the suspect might be. It's Mangione, now he's in this pre-trial hearing today. Great to see you. What happened in the courtroom? Well, we have a lot of news for you, just in that the judge actually threw out the most serious terrorism-related charges filed against Mangione. So now it's down to nine counts that he faces, including second-degree murder. But this is really a blow for the prosecution. They were hoping to get a conviction on these big terrorism-related charges. They made this case that Mangione was trying to incite fear amongst the public, and the judge wrote in a lengthy decision that they didn't provide adequate evidence to meet that terrorism charge. So that just happened. Also, we heard that early in December we're gonna have another hearing where the judge will rule on the defense's requests to have evidence suppressed, like what was found inside Mangione's backpack, including a gun in his backpack when he was arrested at McDonald's. Defense wants all that thrown out, saying it was illegally obtained, that he wasn't read his Miranda rights at the time. So a lot of courtroom drama unfolding. I think this case captured our attention, but there's a lot happening that are not making headlines, but that's all happening today. And if the defense gets that wish, I mean, that would be remarkable if the weapon, I think the manifesto, may have also been in the backpack. If that gets ruled out, who knows what might happen next? But there are still some serious charges he faces. What is the latest on the case and the evidence as it appears right now? Well, right now the judge says, okay, for now, Alvin Bragg, the Manhattan District Attorney's team, they can proceed apace. They can keep going on those other nine charges. Those are related to the gun, multiple gun-related charges, a second-degree murder charge, and then a couple of charges related to that forged ID that he used. If you remember, he had that fake New Jersey driver's license that he was using when he was riding his bike around Manhattan. And remember, there's also a federal case that is playing out at the same time. The next hearing in that case, which could carry the death penalty, prosecutors are seeking the death penalty in that case. That next hearing is December 5th. Very important developments.
