There are several developments in the cases involving Kilmar Abrego Garcia, the migrant in ICE custody whom the Trump administration wrongly deported. CBS News' Katrina Kaufman reports.

Kilmar Abrego Garcia will remain detained for at least 30 days after a federal judge paused his release. This follows a sequence of court orders: one granting his release from criminal custody in Tennessee, another blocking immediate transfer to ICE, and a third allowing him to stay in custody to prevent possible deportation while his legal team considers next steps. 

Abrego Garcia, who was previously deported to El Salvador by the Trump administration and has since returned to the U.S., faces human smuggling charges, which he denies. The courts have stipulated that if deportation is pursued, he must receive 72 hours' notice and be informed of the destination country. Ultimately, he is expected to be released to Maryland under ICE supervision.

And a federal judge has paused the release of Kilmar Obrego-Garcia for at least 30 days. Now this comes after back-to-back rulings. First, ordering his release from criminal custody, and second, blocking ICE from immediately arresting him. And you may remember, Obrego-Garcia was mistakenly deported to El Salvador by the Trump administration and is now back in the U.S. facing human smuggling charges, which he denies. CBS News legal reporter Katrina Kauffman is here with us in studio to talk about this case. Katrina, good morning, welcome back, good to see you. What do these simultaneous rulings mean for Obrego-Garcia's potential freedom? So what's interesting, Errol, is there was even a third order yesterday, because essentially, this judge in Tennessee where there is a criminal case related to human smuggling charges against Kilmar Obrego-Garcia is taking place, determined that he should be released from criminal custody. He denied a government request to keep him in that custody. At the same time, a judge in Maryland where he has a civil case blocked them from turning him over to ICE when he's released. She said he's supposed to be brought back to Maryland where he's from, where his family is, put back under ICE supervision in Baltimore, and she also required that if they try to deport him, they have to give him 72 hours of written notice and let him know what country he would be sent to. Now, the third one is that his attorneys had said that they wanted him to actually stay in criminal custody in Tennessee for 30 days if that judge was going to grant him release, because they're worried about him being deported, Errol, where he could be deported as well, and they want more time to weigh their options. So it's a very unusual request, because of course he's been wanting to be released, so essentially, he is going to remain in custody for another 30 days in Tennessee, and then he should ultimately be released to Maryland. A remarkable sequence of rulings surrounding this one man. Also yesterday, a federal appeals court ruled that President Trump's executive order on birthright citizenship was unconstitutional. Break that down for us. So this was in the Ninth Circuit, Errol. It was a 2-1 ruling. There was a dissent by a Trump-appointed judge, and essentially, this keeps in place an injunction that was issued by a lower court, and they find Trump's order related to birthright citizenship unconstitutional. They say that it is unmoored from the accepted legal principles of 1868, and that citizenship is supposed to be for all people who are born in the U.S. and who are subject to its jurisdiction.
