The analysis estimates at least 460 arrests in New York City, more than twice the number recorded in El Paso, Texas, the city with the next highest count. Nationwide, nearly 2,400 such arrests have likely taken place in immigration courts through July of this year.

The data, compiled by comparing ICE arrest records with immigration court hearings, shows that 93% of those arrested had only civil immigration charges, such as illegal border crossings, rather than criminal records. ICE has not commented directly on the findings, but a spokesperson previously stated that arresting individuals in court is considered common sense. A recent federal court ruling has temporarily limited ICE's ability to deport immigrants without due process, but concerns remain that fear of arrest may deter some immigrants from attending court hearings.

That's more than double the number in the city with the next highest count, El Paso, Texas. The analysis estimates ICE has made nearly 2,400 arrests that likely took place in immigration courts nationwide through July this year. ICE data does not have precise location information on arrests. So mathematician Joseph Gunther brought in a second data set on immigration court hearings to conduct the analysis. By comparing dates, places, and demographic information between the two data sets, he was able to compile a list of arrests that likely took place on the same day as a court hearing. New York immigration attorney Allison Cutler, who is in court almost every day, told CBS News that ICE agents said they are targeting New York City because of its sanctuary policies. ICE did not respond to a CBS News request for comment. But in a press release earlier this year, an ICE spokeswoman said arresting criminal illegal aliens in court is common sense. The data analysis shows that 93% of those arrested had only civil immigration charges, such as crossing the border illegally, rather than criminal records. A federal judge ruling in August temporarily limited ICE's ability to deport immigrants without due process. That blocks one strategy ICE used to make courtroom arrests. But immigration attorneys and advocates are still concerned some immigrants may not show up to court to avoid risking arrest. That was data journalist Julie Ingram with our CBS News Confirmed team.
