The family of a two-year-old who died after falling from the 20th floor of a Newark apartment building has filed a lawsuit against the building's owner. The lawsuit claims that the windows were made of thin plexiglass and lacked required window guards, despite repeated warnings from the child's mother about their safety.

New Jersey law requires window guards in apartments with children under 10, but the suit alleges this was not followed. The Essex County Prosecutor's Office is investigating the incident and will determine if criminal charges are appropriate. The building's management has not commented on the case.

The family of a two-year-old who fell out of a high-rise apartment complex in Newark is suing the building's owner. News 12 New Jersey's Chris Keating is live this afternoon outside the Elizabeth Towers with new reporting on this story. Chris. Nick, good afternoon. The little boy involved in this case was on the 20th floor of this very building, this apartment complex in Newark, when he fell. In this lawsuit, his mother complains that she had told building employees several times that the windows were unsafe, and in this lawsuit, the family claims that these windows were made of plexiglass. Now, this child fell from the window early in the morning on November 15th, a Saturday, and we've now learned that, in fact, the child's mother was inside of the apartment. The lawsuit states that windows in the apartment were not real glass. The suit details that installation of these thin sheets of plexiglass windows that were glued onto the window frame was a cheap patchwork job done so that the owners could save money. The suit also claims that the apartment did not have window guards. In New Jersey, window guards are required by law when there are Children under the age of 10 living within an apartment unit. To this point, the management team with Elizabeth Towers has not spoken about this incident. However, we can tell you that the Essex County Prosecutor's Office is still investigating this death, and they will determine whether or not criminal charges should be applied in this case.
