The Department of Public Prosecution has filed an appeal against Erin Patterson's conviction, arguing that the sentence handed down was manifestly inadequate. Prosecutors had called for the maximum penalty of life imprisonment without parole, citing the seriousness of the crimes and a lack of remorse. 

Patterson is currently serving a life sentence with a non-parole period of 33 years, making her eligible for release at the age of 82. Her legal counsel has indicated plans to appeal the conviction, with the appeal expected to be lodged soon.

In the pre-sentence hearing, prosecutors called for the maximum sentence in Victoria, which is life behind bars without parole. They said the seriousness of her crimes, including a lack of remorse and failing to help medics in the days after the lunch, make this the most serious of crimes, therefore warranting the most serious of penalties. While she is serving life behind bars, her non-parole period is 33 years, meaning she would potentially be eligible for release at 82 years old. While we are waiting for her counsel to officially file an appeal, last week they indicated they would be appealing her conviction and we expect that to be lodged in the first week of November.
