CBS News has learned the so-called "missing minute" from the night Jeffrey Epstein died may not be missing at all. CBS News justice reporter Jake Rosen explains.

CBS News has reported that the Department of Justice (DOJ) possesses the so-called 'missing minute' from the surveillance video recorded at the jail where Jeffrey Epstein died. While earlier released footage appeared to skip a minute, attributed to outdated technology, CBS News has learned that the DOJ holds a raw video file containing the full minute. The previously released video was a screen recording of the original, not the actual raw footage.

The report also notes that Ghislaine Maxwell, Epstein's associate, has agreed to potentially testify before Congress under certain conditions, including immunity. Additionally, the DOJ has filed a complaint against Judge James Boasberg, citing concerns about his conduct during a legal dispute over deportations, though any resolution to this complaint is not expected soon.

DOJ has copy of 'missing minute' from Epstein jail video

CBS News has learned the so-called missing minute from the Jeffrey from the night Jeffrey Epstein died may not be missing at all. Earlier this month, the Justice Department released nearly 11 hours of surveillance video from the jail where Epstein committed suicide in 2019. However, the time code at the bottom-left corner of the video jumps from just before 1159 to midnight. At the time, Attorney General Pam Bondi blamed it on outdated technology. And what we learned from Bureau of Prisons was every year, every night, they redo that video. It was old, from like 1999. So, every night, the video is reset, and every night should have the same minute missing. CBS News Justice Reporter Jake Rosen joins us now. Jake, thanks for being here. What have we learned about this so-called missing minute? Where is it? Well, what we've actually learned, according to our CBS News reporting today, is that the Department of Justice actually has a video clip, the raw video file, that has that minute in it, which leads to a couple questions, Jolene, which is why was that original file, which kind of would debunk a lot of the conspiracy theories out there not released in the first place, like Dan Bongino and Kash Patel and Pam Bondi had all said was the case. In addition, CBS also learned that, based on the metadata of that video, that it was actually a screen recording of the original raw video file. So the Department of Justice didn't actually put out the true file. It's a recording of the recording. And that the theory prompted there by Bondi is just not true, that there is a — that minute is captured in a different footage. And, again, this just leads to another question mark of why tried to, you know, release some kind of not full video and why tried to say that it was blamed on outdated technology when, at least according to our CBS News reporting today, that's just not the case. So Epstein's close associate Gillian Maxwell also has agreed to testify before Congress, but under certain conditions, what's she asking for? And do you think she's going to get what she wants? Well, it's unlikely she gets what she wants because in a letter from her attorney, David Marcus, to James Comer, who's the head of the Republican-led House Oversight Committee, he says that she's willing to potentially sit down with them on a date, which is August 11th as of now, for a conversation, but she's going to plead the fifth unless she's granted some kind of immunity in case she, by the committee, in case she discusses any new developments that have not been previously reported, talks about crimes that have not already been charged, or potentially gets a pardon or a commutation of her sentence from President Trump. The attorney also pointed out that Maxwell has an appeal in front of the Supreme Court and that any further information there could potentially be used to either taint a future jury pool if new charges are brought against someone or affect the appeal of her case as she's going to the Supreme Court, likely to be taken up in the fall, to hear an objection to her conviction in which a promise was made that no conspirators would be charged when Epstein signed his first plea agreement with the DOJ in 2007. That wasn't the case because, obviously, Maxwell and Epstein were both charged in New York in the mid-2010s. So, Jake, before you go, one more thing. The Justice Department has filed a complaint against Judge James Boasberg, who oversaw that legal fight over deportations to El Salvador. Quickly, what is the DOJ accusing him of? The Department of Justice says that in a March conference, right before those planes took off with hundreds of men who were removed from the U.S. under the Alien Enemies Act, that he warned of a potential constitutional crisis if the Trump administration did not listen to court orders. And then they said that the way that he has acted in this case by being strict with the Department of Justice attorneys, casting doubt on their honesty, and, frankly, as I've been in all of these court hearings, basically just not believing the narrator of what the Department of Justice's intents were with these removals, the real story behind it, and whether these people are actually gang members. He's been very critical of them throughout the whole process, including in a hearing last week. They said that this is unbecoming of a judge, and they've referred it to a senior judge in the appeals court for potential sanctions or punishment. It's unlikely that that comes anytime soon, though, JoLynn, because there was one filed in February for a different judge, and there's been no resolution in that case yet.
