Colerain Township officials are responding to complaints from residents along Ray and Drive who have experienced flooding and other problems due to a large dirt pile left by ongoing construction at a Wawa site. The mound, which was not included in the final approved development plan, has led to property damage, including costly pool cleanups.

The township's zoning board is now seeking legal advice on their ability to regulate such earthworks and what actions can be taken if the developer is found out of compliance. One option under consideration is to delay Wawa's business opening until the issue is resolved. The board expects to receive a report from the law director at their next meeting.

Nineties reporter Shonda Lancy has been pressing for this since last Monday and tells us what officials are doing now to fix the problem. Still sitting in the shadow of a mound sitting dozens of feet high. People living along Ray and drive once again told of the problems caused by wall was construction. That mud in the spring flowed into my pool to clean up. That pool was, you know, thousands of dollars in front of the zoning board. They're backing Steve Schnebly, who's led the charge, speaking with us and taking on the township. You approved level ground. Now there's a ski slope. He's not alone. Our reporting has sparked a call for change with the facts that are coming to light with the current W. C. P. O. Investigation. All I can ask is what will you do to help remedy this situation? Since I started looking into this more than a week ago, the way Colerain Township zoning officials have talked about that big pile sitting behind Wawa has shifted. For example, zoning board member Kevin Wilson openly stating this earthen behemoth was not on the final development plan. They approved final development plan did not include the large earthen mound. How? How will it be in compliance with the final development plan? Isn't it already out of compliance with the final development plan? There are some people who have that opinion. Development director David Miller still contends they have no jurisdiction in the county conservation district permitted the construction, but they will look into whether Wawa's work complies with the plan they reviewed and approved once construction is complete. If it doesn't, then the question is, okay, how do you remedy this? The board directed that question to the law director, asking them to answer three things. One. What power do they have to regulate earthworks in general? Two. How does that apply here? And three. What can they force Wawa to do if their work doesn't match the plan zoning approved months ago? Now, members of the zoning board say that one option is to ask Hamilton County not to allow Wawa to begin business until the township's concerns are addressed.
