A federal court has ordered the ABC to pay $150,000 in penalties to Antoinette Lattouf for unlawfully dismissing her over a social media post shared to her Instagram story

The ABC has been ordered by a federal court to pay a total of $220,000 in penalties and compensation to former radio host Antoinette Lattouf. This follows her dismissal after she reposted a Human Rights Watch report alleging the Israeli government was using starvation as a weapon of war. The court found that the ABC breached the Fair Work Act by terminating her employment, with the judge criticising the broadcaster for yielding to external pressures and failing to uphold its independence.

Lattouf stated that her case was about accountability and the integrity of public broadcasting, while the ABC's managing director apologised for the handling of the matter. Both parties have reserved the right to pursue further legal action as they review the court's decision.

One social media post that cost Antoinette Latouf her job has now cost the ABC almost a quarter of a million dollars in compensation and penalties. I was punished for my political opinion. Latouf was let go from her on-air radio host duties after reposting a Human Rights Watch report alleging the Israeli government was using starvation as a weapon of war. In June, a federal court judge found the national broadcaster had breached the Fair Work Act. And today, the ABC was ordered to pay $150,000 in penalties. That's on top of the $70,000 Latouf has already been awarded in compensation. In his written judgement, Justice Rangia said, The ABC's conduct in surrendering to the demands of the pro-Israel lobbyists and taking Ms Latouf off air ignored the equally important statutory obligation of maintaining its independence and integrity. From Latouf came this statement. This was never about the money, she wrote. It's always been about accountability and the integrity of the information our public broadcaster gives us. All I want is for an ABC that is fair and that acts with integrity. For its part, the ABC's managing director apologised and said, The matter was not handled in line with our values and expectations and Ms Latouf, our staff and the public, were let down. So after almost two years of litigation, is it now case closed? Maybe, maybe not. Legal representatives for both parties today reserved any further action while they review the published decision.
