The new fee applies only to future H-1B applicants and does not impact current visa holders or those who submitted applications before the order took effect. The Department of Homeland Security clarified the scope of the policy following initial confusion among companies and workers.

Camilo, good to see you today. For those watching, how can you break down how that new fee works? Good morning, Reid. Well, this is simply put, one of the administration's latest attempts to overhaul and restrict the legal immigration system. As we have discussed on multiple occasions, the administration has mounted this aggressive campaign to crack down on illegal immigration. But with significant less fanfare, it has also moved to overhaul and restrict the legal immigration system. This particular proclamation, Reid, targets the H-1B visa program, which was created back in 1990. And since then, it has allowed American workers to bring in high-skilled foreign workers. And right now, in today's day and age, it relies on many different programs and occupations. But the tech sector, for example, heavily uses this program to bring in foreign workers from countries like India, China, and other nations across the globe. There was some early confusion over the weekend about who was actually affected by this order. And you saw some companies actually, Reid, tell their H-1B workers to immediately return to the U.S. if they were overseas during the weekend. But the Department of Homeland Security had to clarify on Saturday that this order by President Trump only applies to future H-1B applicants, rather, not current H-1B visa holders or people who filed an application for that program before Sunday at 12.01 a.m. that day. And so, this will only apply to future H-1B cases. And in those cases, the applicants and their companies who are looking to sponsor them will have to pay that hefty $100,000 fee, Reid.
