Jean Carroll That's that's remarkable how my Maduro status as head of state Affect the proceedings earlier this morning on CBS morning news You're explaining to me that there could be a type of head of state immunity defense That's right Errol there are some significant objections that Maduro could raise here Particularly this one that he has head of state immunity that is the leader of a foreign nation He should not be able to be prosecuted in u.s. Court. Now. There is some debate here What the u.s. Is arguing is that they don't recognize him as the leader of Venezuela But there was a period when he was recognized. So this is going to be a complicated issue here It is one that's been litigated before with General Noriega from Panama Although the situation was a little bit different something else that I think we'll see come up is Maduro trying to say that the way he was arrested it was unlawful that that is a core issue here However for that to Errol there is case precedent that doesn't matter how the person has ended up in custody They can still be prosecuted here in the u.s Remarkable and Katrina will stay close to your location and your reporting as we get closer to this hearing.
