Legal experts note that the narco-terrorism charges carry a minimum sentence of 20 years in prison under federal law.

Maduro maintains that he is Venezuela's legitimate head of state, but U.S. authorities do not recognize his presidency. The indictment specifically refers to him as the illegitimate ruler, which, according to legal experts, undermines his immunity from prosecution typically granted to recognized heads of state.

Now an important caveat is it has to be the head of state as recognized by the U.S. State Department and the U.S. State Department does not recognize Maduro as the legitimate ruler of Venezuela. That's why it specifically says in the indictment he is the illegitimate ruler of the country. On Monday, U.S. prosecutors laid out their case from a 25-page indictment. They claim Maduro, like his predecessor, participated in, perpetuated, and protected a culture of corruption in which powerful Venezuelan elites enriched themselves through drug trafficking. The conspiracy, you link everybody together. That's part of the chain. Maduro was part of that chain first as a minister of foreign affairs and then later as a president. So, when you're the president of a country and you are giving the green light to engage in this activity and you're putting people in critical positions in governors, ministers, heads of agencies and allowing them to carry out these drug trafficking activities, you're just as guilty as the person making the drugs and transporting the drugs. Maduro, his wife and son, along with their accomplices, have been accused of working with FARC rebels in Colombia, Zetas and Sinaloa cartels in Mexico, and Tren de Aragua from Venezuela. All were labeled terrorist groups by the U.S. State Department last year. According to legal experts, under federal law, the narco-terrorism charge carries a minimum sentence of 20 years in jail.
