An Ohio day care owner, Diana Dillon, alleges that construction by Duke Energy contractors caused severe flooding at her facility after heavy rainfall. Dillon claims that tarps placed under nearby drains during gas pipeline work led to water backing up and significant damage, forcing her to close for a week and resulting in projected repair costs exceeding $70,000. 

Duke Energy acknowledges the area experienced unusually heavy rainfall but denies covering the drains, stating that only approved sediment control devices were used, which allow water to pass through. Dillon's insurance does not cover ground-level flooding, and she believes Duke Energy should be responsible for the repairs based on their easement agreement. The company maintains that the flooding was due to extreme weather conditions.

Rainfall leading to ruin. You cannot see the roundabout like there was so much water. As Diana Dillon says, construction done by Duke Energy contractor left chaos at her daycare. That's what I'm saying. This drain right here was completely backed up and you could just see everything puddling right there. Dylan owns the Morrow Early Childhood Development Center and says crews while working on a gas pipeline place what appears to be tarps underneath nearby drains. They'll not came and clean that out. And after rainfall on July 18th on Saturday morning I came over here and the water was just everywhere. Dylan tells me the damage inside and the water ponding right here in front of her daycares front entrance prevented her from opening for an entire week. For many kids, child care is their safe place, so it really broke my heart. But you know that we were closed besides losing a week's worth of income. She says she plans to start working on that income. She says she projects over $70,000 in repairs. It's a lot of water damage in there. We've worked hard to get two rooms repaired enough to open them up. There's damage to the floors, walls, water damage underneath. There is really making it blow up and cabinets in all four of the daycares classrooms. They will now have to be replaced to them. This is nothing, but to me it's a lot. It's crippling. Dylan's insurance doesn't cover flooding on the ground level, and she believes Duke Energy should pay for the damage based on their easement agreement, which mentions responsibility for actual physical damage. I took Dylan's concerns to Duke Energy, Duke senior project manager overseeing this site, told me. The company acknowledges the area in question received 5 to 7 inches of rain in one hour that day with the nearby Creek rising 12 inches. But in a statement, Duke denies covering drains. They say they use required sediment control devices which include drain protection and water protection. It keeps out sediment, but allows water to go through. But Dylan isn't convinced. I think that they need to take ownership that the fact that there's never been flooding through here before. In Morrow, Jay Shakur WCPO 9 news.
