Strict new laws are being introduced to crackdown on the sale of illicit tobacco and illegal vape products in NSW. The state government says it's part of a commitment to protect the community from smoking harms.

The New South Wales government has introduced new legislation targeting the commercial sale and possession of illicit tobacco and vaping products. The measures include penalties of up to $1.5 million in fines and seven years imprisonment, as well as closure orders for unlicensed sales. 

The reforms also grant landlords the power to terminate leases if their properties are used for illegal tobacco operations. These changes follow the recent implementation of a tobacco licensing scheme and are intended to address ongoing community frustration and support compliant small businesses. Further reforms may be considered in the future.

The smoke is rising on another attempt to combat a rapidly growing issue. The community has clearly had enough, I've had enough. The New South Wales Government introducing some of the toughest penalties on the sales of tobacco and vaping goods the country has ever seen. This is about regulating an environment that now for too many years has been allowed to go unregulated. The new laws being introduced include any commercial possession or sale of illicit tobacco carrying a maximum penalty of over $1.5 million and seven years imprisonment. The introduction of closure orders for the sale of goods without a licence. Opposition leader Mark Speakman claiming Labour's only proceeded with the laws because of months of political pressure and growing community frustration. Finally the government is acting and more or less copying what the opposition has proposed. What I'm not interested in is who's doing what, what I'm interested in is making sure that we're going to respond as best we can to community concerns. Legitimate retailers pleased to see action being taken. This would be a positive step forward in trying to stop people smoking. The new reforms give landlords lease termination powers where they'll be able to end their lease with tenants if they use their property for illegal tobacco operations. I think it would be pretty frustrating that there is likely to be, not always, but there is likely to be a criminal element involved in the operation of a premise that you lease out to someone. This string of changes will complement the tobacco licensing scheme which came into effect on July 1st, however Park says it won't be the last. There's likely to be more reform needed in this space. For now the state government hopes it will at least level the playing field for small businesses who do the right thing. Emma Olsen, 10 News.
