The intelligence authority has received bipartisan scrutiny by lawmakers who have sought reforms.

The process of reauthorization has drawn bipartisan attention, with lawmakers from both sides of the aisle calling for reforms to the intelligence authority, highlighting the scrutiny under which this surveillance tool has been reviewed.



House votes to reauthorize FISA spy program

Fourth, only get passed with a bipartisan majority in the House of Representatives. The Senate will now have to act before FISA expires on April 19th. We have not yet heard from Senate Majority Leader Chuck Schumer, who is the one who is expected to announce those next steps with regard to the bill. This was an extremely contentious vote over the past couple of weeks. There's a number of Republicans who wanted some key changes in order to even get the bill on the floor earlier today. They had to agree to reduce the time of this renewal of FISA down from five years to just two years. That was to allow them to even consider the bill today. They also considered a bunch of amendments. Probably the most controversial amendment was the first vote that they took, which was an amendment which would have required wider requirements for getting a warrant if you want to conduct surveillance on Americans. Now right now, the Foreign Intelligence Surveillance Act covers the intelligence and surveillance of foreign powers, but sometimes Americans get caught up in that surveillance. That's what FISA Section 702 deals with. So what that amendment would have done would be require the federal government, with limited exceptions, to get a warrant in order to conduct warrantless surveillance on Americans. That amendment vote tied in the House of Representatives. I can't stress how rare that is, that it tied the exact number of people voting for it and voting against it. Ultimately, a tie vote in the House of Representatives does not have a tiebreaker, meaning the amendment vote failed. Ultimately, FISA, the Foreign Intelligence Surveillance Act, was extended for two years in the House. It now goes to the Senate. We have not yet heard from Senate Majority Leader Schumer what the plans are. But again, it needs to be renewed by the Senate before April 19th. That is the deadline before the program expires. So a lot developing in the last couple of minutes here, and a lot of angry conservatives appear on Capitol Hill upset about the fact that that amendment, which was championed both by progressives and some conservatives, did not make it through.
