Abrego-Garcia was previously deported to El Salvador in error and returned to the U.S., where he faces new criminal charges. The White House alleges he is a member of the MS-13 gang, an accusation he denies. His legal team argues he fears persecution in Uganda, and he has declined a plea deal that would have resulted in deportation to Costa Rica.

On Wednesday, a federal judge extended a temporary restraining order blocking Kilmar Abrego-Garcia's removal until the case challenging his deportation to Uganda is resolved. The judge at one point said he couldn't be sent to El Salvador, but that means he could be sent anywhere else. The bottom line is he doesn't get to choose where he gets deported to. Government officials are expected to testify at an October 6th hearing, and then a ruling will be issued within 30 days. Abrego-Garcia was returned to the U.S. in June after being mistakenly deported to his native El Salvador. He was immediately put in federal custody and hit with new criminal charges in Tennessee. The White House insists the 30-year-old is a member of the violent MS-13 gang, something he denies. After being released to await trial, he was taken back into ICE custody on Monday. His attorneys told a judge this week he wants to seek asylum in the U.S., arguing he has the right to express fear of persecution in Uganda. For them to insist on fighting out a deportation to Uganda shows that the real motive in this matter is not getting him out of the country, it's punishing him and keeping him locked up.
