A Green Lake family is pushing for legislative change after learning the 85-year-old woman who struck and killed their 12-year-old son while he was riding his bike will not face criminal charges.

A 12-year-old boy named Emmett was fatally struck by a car while riding his bike near the Green Lake library. The driver, an 85-year-old woman from Germantown, accidentally pressed the accelerator instead of the brake while parking, resulting in the collision. Police determined that the driver was not under the influence, distracted, or criminally negligent, and as a result, she will not face charges. Emmett's family, shocked by the decision, is now advocating for legislative changes to prevent similar incidents, including seeking meetings with state officials. The community has rallied in support, raising funds to honor Emmett's memory through local initiatives.

Angela Zodro tells me her son Emmett was Green Lakes kid. He was loved by all in this community, but earlier this summer while riding his bike on this sidewalk, he was struck and killed, and we've learned that the Germantown woman who hit him will not face any charges. It's left the family in shock and now looking for change. It's still difficult for the Zodro family to think about their dear Emmett. He loved this town. He loved life so much. Everybody knew it. You just felt it when he was around. The 12-year-old was struck and killed near the Green Lake library while riding his bike. Police say 85-year-old Jean Woolley of Germantown was trying to park her car when she hit the boy, hitting the accelerator twice instead of the brake. You're supposed to maintain control of your vehicle. You're supposed to be aware of your surroundings. This body camera footage shows Woolley explaining what happened right after the crash. I put the brake on. Okay. And then I panicked and pushed the car out. Woolley, visibly upset later on, says it was an accident. She took an innocent child's life. That's more than just an accident. Was it intentional? No, but that's a lot of carelessness. The Green Lake Police Department says Woolley was not criminally negligent. An investigation uncovered she was not under the influence of drugs or alcohol and was not distracted during the time of the crash. When you see a person can make a mistake so big and so bad that a child dies and they can keep on driving, what stops anybody from ever saying, I probably shouldn't be driving anymore? Now the Zodro family is hoping change will come at the state level to keep drivers better in check, especially after a tragic incident like this. It doesn't make sense to let this person keep driving like this. How is there nothing we can do? They'll meet with the governor's office on Friday. Emmett's legacy will continue to live on through different community initiatives that the family is working on right now.
