The American Civil Liberties Union (ACLU) has filed a lawsuit against the federal government, arguing that Lopez Campos is being denied due process by not being granted a bond hearing, which traditionally allows long-term residents to seek release while their immigration cases are pending.

According to the ACLU, recent changes in federal policy under the Trump administration have led to the denial of bond hearings for immigrants like Lopez Campos, a move that federal judges across the country have found unlawful. The judge in Lopez Campos's case has not yet issued a decision but is expected to do so soon. The case is part of a broader pattern of legal challenges to the administration's immigration detention practices.

He came here from Mexico about 30 years ago and now the ACLU says it's fighting to get him some justice. Fox News Ingrid Kelly joining us live with more on a federal hearing that was held just a short time ago. What happened, Ingrid? Well, you know, there were a lot of tears shed after that hearing right outside of federal court. The family says their father is being denied due process. Now his name is Juan Manuel Lopez Campos and now the ACLU is stepping in to fight on his behalf. Joining me now is Attorney Phil Meir. Good afternoon. Good afternoon. So this is really about Bond being denied for your client. Yeah, for decades it's been understood to be the law in this country that when people are caught crossing the border, they can sometimes be detained. But if they are caught and charged with an immigration offense while they are already living in the community and have been here for a long time, then they're entitled to a Bond hearing and they can be detained but only if they're found by a judge to be a flight risk or a danger to the public. The Trump administration has suddenly and radically reinterpreted that law, even though nothing has changed. And they're now claiming the right to hold immigrants who they charge with no Bond hearing at all, complete denial of due process. That's what happened to our client, who's a 26-year resident of this country, has raised U.S. citizen children and grandchildren, and is being locked up and held while he's trying to fight his immigration case and establish his right to stay here with no due process and no chance for a Bond hearing. Right. Now, we know today no decision was made. Does that give you a little hope? The judge today indicated that she intends to issue a decision quickly. And this is one of cases like that have been happening like this around the country because it's a nationwide cruel policy by the Trump administration. Every federal judge to look at this issue has concluded that the Trump administration is acting unlawfully and unconstitutionally. And we're hopeful that the judge will do the same thing here. Exactly. It sounds like she's taking her time to actually comb through all of this and look at the details and make an informed decision. Talk to me. ACLU chapters across the country, are they all kind of dealing with similar situations? Yeah, there have definitely been lawsuits like this by other ACLU chapters. There have also been lawsuits like this by other people. And again, what I want to emphasize is every single federal judge who has looked at this issue has concluded that the Trump administration is violating the law and attempting to reinterpret a 30-year-old law that has been understood the same way by every administration before it, Republican or Democrat.
