Two justices of Brazil's Supreme Court have voted to convict former President Jair Bolsonaro on charges of leading a criminal conspiracy to overturn the 2022 election. The charges are based on a federal police investigation that alleges Bolsonaro was involved in plotting to remain in power after his electoral defeat, including inciting riots in January 2023 when government buildings in Brasilia were stormed by his supporters. 

Justice Alexandre de Moraes, who was reportedly a target in the alleged coup plot, and Justice Flavio Dino both voted to convict Bolsonaro on all counts. The five-judge panel is now one vote away from a majority decision. If convicted, Bolsonaro could face up to 40 years in prison, though his supporters hope for a future presidential pardon.

Two Brazilian Supreme Court justices on Tuesday voted to convict former President Jair Bolsonaro of leading a criminal conspiracy to overturn the 2022 election. The charges stem from a federal police investigation that uncovered the alleged plot to remain in power after his defeat in the election, including plans to poison his opponent and his running mate. The charges are tied to Bolsonaro's alleged incitement of riots in January 2023, when thousands of his supporters stormed and ransacked the Congress, Presidential Palace and Supreme Court in the capital, Brasilia. His lawyers have maintained his innocence on all counts. The first member of the High Court to cast his vote on the case was Justice Alexandre de Moraes, an alleged assassination target in the coup plot. He voted to convict Bolsonaro for all the crimes for which he had been charged. The leader of the criminal group makes it clear, publicly and vocally, to the entire society that he would never accept defeat at the ballot box, a democratic defeat in the elections, that he would never accept or comply with the will of the people. Moraes' role in the case has made him a target of Bolsonaro's allies, including U.S. President Donald Trump. Trump's administration imposed sanctions on the judge and steeped tariffs on many Brazilian exports to the U.S. for what Trump called a witch hunt against the former Brazilian president. Justice Flavio Dino also voted on Tuesday to convict Bolsonaro on all counts. The five-judge panel is now one vote away from a majority convicting Bolsonaro of orchestrating an attempted coup to remain in power. After his 2022 electoral defeat to leftist President Luiz Inácio Lula da Silva, three more Supreme Court justices will vote Wednesday morning, including one appointed by Lula. Two justices appointed by Bolsonaro are not on the panel. If convicted, Bolsonaro faces a maximum potential sentence of 40 years. However, his supporters hope a future president might grant him a pardon.
