A sexual assault charge against Tony Humby was dropped after the complainant died in the fall of 2024. The Crown had considered using the complainant's police statements as evidence but ultimately decided not to proceed, leaving Humby facing 71 charges involving 10 complainants.

The trial, ongoing since the summer, was further delayed due to a dispute over evidence related to three child pornography charges. The judge granted an adjournment, and new trial dates have been set for the last two weeks of January.

Crown prosecutor Deidre Badcock made a reluctant decision on Thursday, calling no evidence on a single charge of sexual assault in the case of a young complainant who died in the fall of 2024. The Crown had planned to bring a so called con application to allow the person's statements to police to be entered as evidence after their death. Anticipating that would draw some push back from the defense and hoping to wrap up her case, Badcock opted to drop it instead. That means Humby is now on trial for 71 charges related to 10 complainants, but there was another issue on Thursday that sent the trial off the rails again. A disagreement over evidence used to support three child pornography charges. Defense lawyer Mark Grosche said Thursday morning was the first time he'd been able to see the images and metadata in question. Badcock insisted Grosche could have seen it earlier if he'd gone to RNC headquarters to view it in person. Ultimately, Judge Ralph Pritchard allowed the adjournment and new dates have been set in the last two weeks of January in a trial that's been ongoing since the summer.
