A New South Wales court has ruled that recent anti-protest laws, which allowed police to issue move-on directions to protesters near places of worship, are invalid. The legislation was introduced following an incident initially thought to be an anti-Semitic attack but later determined to be a criminal scam. The court found the law impermissibly burdened the implied constitutional freedom of political communication. While the state government expressed disappointment and is reviewing the decision, the Palestine Action Group, whose legal challenge succeeded, stated it has not targeted places of worship and will continue its protests elsewhere. Jewish community representatives voiced concerns that the ruling could impact the safety and freedom of religious practice.

NSW protest laws ruled invalid by Supreme Court

An emphatic legal victory for the state's most prolific defenders of protest. Today's judgment is a resounding win for all of New South Wales, for our democracy and our right to protest. Controversial anti-protest laws were rushed through Parliament earlier this year and in part authorised police officers to issue move-on directions in relation to protests occurring in or near places of worship. Legislation introduced in the wake of the Durrell caravan plot, initially feared to be an anti-Semitic attack but later described by police as a criminal con job. Lawyers for the Palestine Action Group argued the wording of the amendment was too broad and gave police too much power. Ultimately a court agreed and today Justice Anna Mitchell-Moore ruled the legislation is invalid. The law impermissibly burdens the constitutionally implied freedom of political communication. We absolutely will continue to protest as a Palestine movement here and all around the world. It remains a crime to intimidate, threaten or harass anyone accessing their place of worship. The state government says it's disappointed and will now take time to consider today's judgment. Meanwhile the Palestinian Action Group says despite its legal victory, it has no plans to hold any protests outside places of worship. A rally was held outside the Great Synagogue last year where a member of Israel's Defence Force was speaking. But lawyers argued that shouldn't be considered a religious event. The Palestine Action Group has not organised a single protest targeting a place of worship this entire time for the last two years. From the Jewish Board of Deputies, today's decision puts at risk the right of all people to practice their faith freely and safely.
