The court will decide whether statements made before Mangione was read his Miranda rights and items found in his backpack, including a 3D printed gun and notebooks, can be admitted as evidence.

Mangione's defense argues that both the statements and physical evidence were obtained in violation of his constitutional rights. The outcome of these hearings will impact both the state and federal cases against Mangione, with a federal hearing scheduled for January to address similar issues and the potential removal of the death penalty.

Murder suspect Luigi Mangione will be in court this morning here in New York City. The 27-year-old is accused of gunning down UnitedHealthcare CEO Brian Thompson in Manhattan almost one year ago now. Mangione has pleaded not guilty to both state and federal charges against him. CBS News legal reporter Katrina Coffman is outside of the courthouse and joins us now with more. Katrina, good morning. Update us on this case and why Miranda rights are a key detail we'll hear about today. Good morning, Errol. So this hearing is all about what statements and evidence can be let in during this trial and where the Miranda rights come into play, Errol, is that when the police arrested Luigi Mangione, his lawyers argue that they took about 20 minutes to read him his Miranda rights. They say anything that Luigi said before that should not be allowed as evidence. They also take issue with items that were found in his backpack when Mangione was arrested in Pennsylvania. That includes a 3D printed gun and notebooks that the prosecution has said contained what they called a manifesto. So what the judge is doing, Errol, is holding suppression hearings. These are hearings where he'll determine what physical evidence, what statements can be allowed in. The defense says that taking those items from the backpack violated Mangione's Fourth Amendment right against illegal search and seizure and that his statements were protected under the Fifth Amendment. After he was read his Miranda rights, he decided to stay silent, Errol. So these suppression hearings, it sounds like, will set the tone for this case. Update us on where it stands because you have both a federal and state case against him. That's right. What is decided here could have a real impact on how this trial moves forward, on what each side will do for its case, whether the prosecution can bring in what is potentially key evidence, how the defense will be able to shape their case. The court does have a tendency to allow evidence in, even if it was potentially obtained illegally, if it could have been obtained through lawful means. But what Mangione's attorneys say is these items are fruit of the poisonous tree. They were obtained illegally. They should not be allowed in. Now, when it comes to the federal case, we're also expecting a hearing for that in January, Errol. Mangione's attorneys are trying to get the death penalty off the table there and very similarly, they also don't want this evidence included in that trial.
