The suit, brought by the ACLU of Illinois and the MacArthur Justice Center, claims detainees are being held for extended periods without adequate food, water, medical care, or access to attorneys, and are pressured to sign legal documents in English, which many do not understand.

The lawsuit was initiated by two Illinois residents originally from Mexico, who were recently transferred out of state. Defendants include DHS Secretary Kristi Noem and Border Patrol Chief Gregory Bovino. The Department of Homeland Security has not yet commented, and a further court hearing is scheduled.
