A federal judge has temporarily blocked the deployment of National Guard troops to Portland, Oregon, by the Trump administration, issuing a preliminary injunction that will remain in effect until a final ruling is made. The judge stated that there was no credible evidence that protests in the city had grown out of control or amounted to a rebellion, and noted that local authorities had not requested federal military assistance.

The judge emphasized the importance of reviewing extensive evidence and testimony before making a final decision, which is expected by the end of the week. This case is being closely watched as it addresses the balance of power between federal authority and judicial oversight, and could influence similar cases in other states.

Judge to rule on National Guard deployment to Portland

A federal judge has once again blocked the Trump administration from deploying National Guard troops to Portland, at least until Friday. The judge said she, quote, found no credible evidence that protests in the city grew out of control before President Trump federalized troops. CBS News legal reporter Katrina Kauffman is here with me in studio for more on this important case. Good morning, Katrina. How did the judge explain her reasoning for this ruling? And I guess the final decision comes at the end of the week. That's right, Errol. So this is a preliminary injunction. Basically, the judge said she needs some time to weigh the voluminous evidence exhibits in this case, the three days of testimony that we heard last week. So she issued this preliminary injunction. It means that no National Guard, not from Oregon, not from other states, can be deployed into Portland. She says she'll make a ruling on Friday by 5 p.m. Pacific time. But what she said is she believes it's more likely than not that the plaintiffs will prevail in this case. That is the state of Oregon, the city of Portland. She believes, after hearing this evidence, that she doesn't think that there was something that amounted to a rebellion going on at the ICE facilities, that they were, in fact, able to execute the laws there with regular forces. Even though over the summer in June, there were some violent protests that got a bit out of control, that things have been more calm since then. And anything that's happened, that they've been able to intervene. If the driveway was blocked, they were able to clear it. She pointed to the fact that there was even testimony from the Deputy Regional Director of Federal Protective Services, who manages that building. They were surprised by Trump's order. They hadn't asked for help from soldiers. They learned about it on the news arrow. And ultimately, she said that while there were sporadic, isolated instances of violent behavior towards federal officers and property damage to a single building, that it doesn't appear to be backed by an organized group here trying to overthrow the government. So there's this claim that there's an Antifa movement trying to overthrow the government here. So ultimately, this is a preliminary decision. She's still going to make that ruling on the merits. But so far, she believes the National Guard should not be deployed into Portland. And so that's where this decision will land, unless she's convinced by something she sees in the evidence in the next few days. And the reason everything you're laying out is so crucial is because the administration says, we had to send in these troops because Oregon couldn't handle this rebellion from within. The judge is saying she doesn't see evidence of that. That's right. And I think what's also important here is the government is also saying you don't even have the right to review this, that there's great deference to the president here, that he has the authority to make this decision. And in this preliminary injunction, she said, yes, I do. I can, one, issue the preliminary injunction that the government actually argued she couldn't do. They said she just had to make a ruling on the merits here. They also said she can't make a decision over the president's authority. She believes that she can. And this is also something that other states can look to. It won't set any kind of binding precedent in other places where this is happening, but it's a test case for how a judge is responding to the Trump administration trying to deploy the National Guard, how she's defining certain terms here like rebellion or regular forces, something the Supreme Court will also be doing. So it's an important case for us to look at from across the country. Yeah, a real question of who has the power. Is it the executive branch? Is it these judges? We'll continue to watch closely.
