Community members have rallied in support of the family, raising funds for legal expenses and receiving assistance from Congressman Eric Swalwell. Multiple legal appeals, including to the Supreme Court, have so far been unsuccessful, and the case is now before a district court. The Department of Homeland Security has not responded to inquiries regarding the case, and the timeline for a resolution remains uncertain.

The family of Miguel Lopez says he was deported more than two months ago, despite having been going through the process of getting his residency. New at 6, KTVU's Crystal Bailey joins us live tonight right here in studio after speaking with Lopez's wife, who's still fighting to bring him back. Crystal? Yeah, Mike. Miguel Lopez was taken from an immigration facility in San Francisco during a routine check-in back in May, and his attorney says he was given a green card, but it was taken away from him. And now that family is left separated and distraught, trying to bring him back. Rosa Lopez is dealing with the aftermath of what she says is her husband's wrongful removal. Knowing he would come home every day by a certain time and you still expect for him to pull up and not see that, it's hard. She says she's flown to Mexico City twice to visit him since he was deported on June 7th. It was hard. It was nice, but it was hard because I had to leave my kids behind. It's just, it's hard having to have a split family when you were always together. Miguel Lopez was taken by ICE officers in San Francisco on May 27th when he was attending a regularly scheduled immigration check-in. His attorney says he was granted a green card, but the Department of Homeland Security appealed the decision, even though he hadn't committed any crimes since entering the U.S. at 18 years old. Getting status here in the United States is not as easy as filling out an application like getting a job. It's not. It's all a process. Working as a welder, Miguel raised three kids with Rosa and has a three-year-old granddaughter who now only sees him from behind a screen. Her papa was here every day, and then all of a sudden he's gone. And life without him hasn't been easy. He tells me, you gotta promise me you're gonna do good, and you promised me you were not gonna cry no more, but it's impossible, it's hard. Miguel was detained for 10 days in the Central Valley and sent back home to his home country of Mexico. His family has been fighting for his return ever since. We won't give up. With the support from the community, who rallied alongside her in downtown Livermore after he was taken, and helped her family raise nearly $60,000 to cover legal expenses, even getting support from Congressman Eric Swalwell, who helped Miguel get his passport back from ICE, the family says. We're hoping this really works for him to get his green card back. After taking it to the Supreme Court, who declined to hear the case, and filing appeals which were unsuccessful, Miguel's case currently sits in the district court, his attorney trying to get Miguel due process. We believe there would be a gross miscarriage of justice if Mr. Lopez's green card is taken away without him getting the opportunity to seek review of that decision. And in the meantime, Rosa continues to take care of her family alone. We have a long battle ahead of us, it's gonna be a difficult case, no question about it. Now we reached out to the Department of Homeland Security but did not hear back in time for this report. In the meantime, Rosa says she hopes to visit Miguel again in September and hopefully bring more family members along. The next court hearing is set for October, but the timeline for a resolution for her is unclear.
