The suit, initially filed in February, alleged that OpenAI and its CEO Sam Altman had strayed from their original mission of advancing artificial intelligence for public benefit rather than for profit. Musk's attorneys requested the California State Court to dismiss the case without specifying a reason.

The lawsuit represented a peak in Musk's ongoing opposition to OpenAI, a startup he co-founded. OpenAI has since become a leader in generative AI, bolstered by significant funding from Microsoft. In contrast, Musk launched his own AI startup, XAI, last July. Musk's suit sought to compel OpenAI to make its research publicly available and to prevent the company from using its assets for financial gain, particularly for Microsoft.

OpenAI characterized the lawsuit as an attempt by Musk to further his own AI interests. Neither OpenAI nor Musk's attorney provided comments on the dismissal of the case. Notably, Musk dismissed the case without prejudice, allowing for the possibility of refiling in the future.
