The immediate venue for this clash of branches involves Trump's attempt to deploy the National Guard to Portland. The latest? A federal judge, a Trump appointee, blocked the deployment. Trump is not the first president to launch sweeping tests of constitutional boundaries. When Truman seized the steel mills during a labor strike, he claimed the president has, quote, the power to keep the country from going to hell. But where Truman responded to undisputed facts, a genuine labor strike threatening wartime production, Trump is making up facts, according to judges, misusing the very system designed to determine those facts. Judge Karen Immergat wrote that the president's assertions about Portland were, quote, untethered from the facts. In another case, Judge William Young, a Reagan appointee, dismissed the government's explanation for masked ICE agents as, quote, disingenuous, squalid, and dishonorable. In yet another case, Judge Meredith, appointed by President George Herbert Walker Bush, threw out Trump's lawsuit targeting the New York Times, writing that, quote, a complaint is not a megaphone for public relations. This language questioning basic facts recalls rulings from judges across the country responding to then-candidate Trump's claim that the 2020 election was stolen. Charges require specific allegations and then proof, one judge wrote. We have neither here. Presidents clashing with the courts is expected. That's how the system is supposed to work. But what judges are pointing out here isn't just an argument over how much power the president should have. It's a pattern of claims built on a fiction, a challenge not to the system's balance, but to its foundation.
