If the law known as SB4 took effect, it would be enforceable in all of Texas's 254 counties, all the way from here to Amarillo, down to Brownsville, Texas. The constitutional issue it once again touches upon is, does a state have the power to enforce its own immigration laws, or is that a power solely reserved for the federal government? The Texas law that gives state and local police the power to arrest migrants who cross into the state unlawfully and deport them, is now in the hands of the 5th Circuit Court of Appeals. Texas has decided that we are at the epicenter of this crisis, we are on the front line, and we are going to do something about it. The Biden administration argues the measure is unconstitutional, that those powers belong only to the federal government. The Supreme Court didn't rule on the merits of the law, but cleared the way for it to take effect Tuesday, pending appeals. Then a late night order from the 5th Circuit put the law on hold again. In Wednesday's hearing, the appeals court appeared divided. Chief Judge Priscilla Richmond, a George W. Bush appointee, seeming skeptical, quotes a 2012 Supreme Court ruling against Arizona that puts the power to admit or remove migrants with the federal government. It seems to me this statute washes that away. Judge Andrew Oldham, a Donald Trump appointee, asked about states' powers on immigration. Is there anything a state can just do because it thinks it's a good matter for the people of the state of Texas, outside of what Congress has allowed them to do? The court, considered to be the most ideologically conservative in the appellate system, is still mulling a decision. In reaction to the latest legal machinations at the federal level, Texas' Governor Greg Abbott once again saying that this is Texas defending itself against a, quote, invasion. Legal observers and immigration advocates I've spoken with say that the clause in the Constitution he cites has more to do with a foreign military or a nation invading the state of Texas as it would to migrants and refugees seeking safe harbor in the United States of America.
