Lawyer Nora Husainovic is leading a legal effort to overturn Kosovo's ban on wearing religious headscarves in public schools. Despite the country's Muslim majority and constitutional guarantee of religious freedom, a Ministry of Education directive prohibits religious uniforms in state schools. Husainovic's initial lawsuit was dismissed by the Supreme Court, but she plans to continue her challenge, including taking the case to the Constitutional Court.

The issue gained public attention after a student was suspended for wearing a headscarf, prompting widespread outcry and a reversal of the decision. While many Kosovars support the ban as a measure of state neutrality, critics argue it limits educational access for girls who wish to wear headscarves. Private schools may allow religious attire, but not all families can afford them.

No headscarves in Kosovo's classrooms

Lawyer Nora Husainovic is fighting for girls to be allowed to wear headscarves in class in public schools in Kosovo. Although more than 95% of the country's population is Muslim, Kosovo is constitutionally a secular state. Although the Constitution guarantees religious freedom, a directive from the Ministry of Education has banned the wearing of religious uniforms in public schools. Husainovic is challenging this rule. The lawsuit she brought against the Ministry's directive was dismissed by the Supreme Court, but she's determined not to give up. The most recent example of a student being excluded from school on these grounds was in 2023. It involved Sara Bungu from the town of Stime. The school principal suspended Sara from classes for a week for wearing a headscarf to school. However, the public outcry was so great that he reversed his decision. The first challenge is that I have to go to school, to a public school, and the principal says that he doesn't want me to wear a headscarf. The right to education has every right, regardless of whether it's voluntary or not. I don't want to compromise education or violate the right to voluntary education. On being contacted by DW, the Ministry of Education declined to comment. However, many Kosovars support the Ministry's decision to apply the directive. I think that the state of Kosovo has decided to make this case neutral, because if a woman has the right, all women should have the right. Nora Husainovic stresses that while she's not questioning Kosovo's status as a secular state, she does disagree with the way the authorities interpret it. In her eyes, they're using the principle to prohibit girls from wearing headscarves in schools. We will use all the legal means that are available, such as the legal framework, to advance the right to education in public schools. For girls who want to wear headscarves to school, there are very few options. While private schools are often more flexible with respect to the wearing of religious uniforms, not everyone can afford them. Nora Husainovic is continuing her challenge.
