Robert Robertson wearing a prison jumpsuit listened Wednesday as his defense argued against setting an execution date. Ultimately, Judge Austin Reeve Jackson said he didn't have the power to hear evidence on why a new date shouldn't be set and proceeded. The court is going to order that execution be set at the time after 6 p.m. on the 16th of October, 2025. In 2002, Robertson said he found his two-year-old daughter Nikki unconscious after she fell from her bed. He was accused of shaking her to death and convicted of murder a year later. The defense here is vigorously arguing that the conviction is based on junk science, that it shouldn't hold up, that the death penalty is inappropriate. Robertson's 2016 execution was halted after his defense said the shaken baby syndrome argument was considered junk science. Experts say symptoms of shaken baby syndrome can be caused by a fall or other accidental injuries in extreme cases. State law allows for convictions to be overturned if the science at the heart of a case has changed. Since April, the state's highest court has been considering his latest appeal. I'm horrified that a date has been set. Gretchen Swinn is one of Robertson's lawyers. So our last filing was accompanied by volumes of exhibits, adding yet more to the portrait of why this is an innocent man. And so to put that pressure on the court of a ticking time bomb is not rational.
