Luigi Mangione appeared in a New York federal courtroom for the first time since April 2025, facing a hearing centered on whether a murder charge carrying the possibility of the death penalty should proceed. His attorneys argued that the prosecution's case for the death penalty is not legally sound and sought to have the charge dismissed.

The hearing also addressed the admissibility of evidence, including items found in Mangione's backpack, but no decisions were made on these issues. The judge did not set a trial date, citing outstanding motions, but indicated a potential timeline depending on whether the death penalty is pursued. Another hearing is scheduled for later in January.

Well, this is the first time we've seen Luigi Mangione in a federal courtroom since April of 2025. He looked different than he typically does during his state hearings, where he's allowed to wear plain clothes. Here he was wearing his MDC tan jumpsuit. He didn't have handcuffs on, but he was shackled at his ankles. He was sitting in between his attorneys, Mark Agnifilo and Karen Friedman Agnifilo, as the hearing began. They were having casual conversation. He did look very calm, but remember, this hearing has to do with a death penalty, at least for the most part. His attorneys are trying to get counts three and four thrown out. One of those is a murder charge that carries the possibility of a death penalty. They say the prosecutor's argument is not legally sound, and that is why this death penalty charge should be thrown out. Now, this was about a four-hour, three-and-a-half-hour hearing. It was very in the weeds at parts. Lots of theoretical discussions about stalking, about the intent, about fear, and whether any of those really contribute to this potential charge. The prosecutors say that Luigi Mangione stalked Brian Thompson, the UnitedHealthcare CEO, not only in person that morning, but also online, and that's why they believe the charge needs to stick. Luigi's team bringing in a special attorney from Maryland to argue this case, adding him to the legal team. He already has his main attorneys, as well as a special death penalty attorney for this particular case. But then they added this third attorney, or this extra attorney, rather, in to bring this argument as well. There was also discussion about evidence similar to what we saw in December during that three-week suppression hearing in the state court, where they're trying to get evidence thrown out, particularly related to his backpack and related to the journal that was found inside of the backpack. The defense offered to have similar hearings as to what we saw in December. Those were three weeks long, where we saw multiple officers who were there that day really recounting the exact same story. The judge did not make a decision as to whether or not these items will be thrown out, but she said she didn't necessarily see the need at this point for a suppression hearing, especially one of that magnitude. And so no decisions were made as far as the death penalty charge or these pieces of evidence. So we are going to have another hearing later in January to discuss more motions, and it'll be kind of another pickup hearing from what we saw today. And Alex, do we know anything about a trial date? You know, the judge had said the last time we saw her that this hearing was one where she intended to set a trial date, but right off the bat, she said she had a lot of motions to decide, and there's basically a trickle-down effect, so she did not want to set a trial date today. But that being said, at the end of the hearing, she did consider a proposal by the government that said if this is not a death penalty case, that the trial would happen in the fall, and that if it is a death penalty case, which usually takes longer to prepare, that the trial will likely happen in January of next year. She said that that was her thinking similarly, but again, she did not agree to that, but she said that that was at least somewhat in line, timeline-wise, with what she was thinking.
