John Benuelos, who was previously charged for firing a gun during the January 6th Capitol riot and received clemency in 2025, has been arrested in Cicero, Illinois. Authorities allege he committed aggravated kidnapping and sexual assault in Utah in 2018, with a DNA test linking him to the case. 

Benuelos is currently being held without an attorney listed and is not available for comment. He is one of several January 6th defendants who have been arrested on new charges after being granted clemency. In related legal news, James Comey and Letitia James are seeking dismissal of their criminal cases, arguing improper appointment of prosecutors and selective prosecution.

We want to jump to a CBS News exclusive. A man facing charges for firing a gun into the air during the January 6th Capitol riot. He's facing more charges. John Benuelos is now accused of kidnapping and sexual assault in Utah. CBS News Justice Correspondent Scott McFarlane joins us now from our D.C. bureau with more on what he is discovering about this case. Scott, good morning. You actually broke this story. Break down for us what you're seeing and what this means. Yeah, our reporting posted overnight at CBSNews.com. John Benuelos wasn't just one of the 1,500-plus January 6th defendants. He was distinctive and uniquely high-profile. He was accused of pulling a gun while amid the mob on Capitol grounds and opening fire into the air. His case was among the latest wave of cases. It was from 2024. He hadn't even gone to trial yet when he received the clemency, like all other January 6th defendants, on Inauguration Day 2025. So he was released. His case was over. CBS News has learned he has been arrested in the Chicago area in Cicero, Illinois, outside of a Burger King, where he was spotted by law enforcement, who knew he had a warrant in Utah, issued October 1st. What was the warrant for, Errol? It was for, according to prosecutors in Utah, aggravated kidnapping and sexual assault of a woman there back in 2018, at some point in August of 2025. According to prosecutors, a DNA test matched Benuelos to the sexual assault of a woman from seven years ago. He's been arrested. He's being held. He does not yet have an attorney listed, nor is he reachable for comment. But he is the latest, the latest in a series of January 6th defendants who were pardoned or issued clemency in January, who have been arrested again, now in different cases. Remarkable. I want to jump to another big topic, because both James Comey and Letitia James are seeking to get a judge to dismiss their criminal cases. They both have extensive backgrounds in law enforcement. So what can you tell us about these new filings from overnight? Errol, they're both making a different pair of arguments, similar arguments, but they're making more than one each. Letitia James and James Comey are each arguing that the prosecutor assigned to their case, who signed her name to the case, was unlawfully appointed by President Trump. Therefore, the case should be dismissed. Last night, though, they also submitted secondary arguments, that this is vindictive, selective prosecution. According to James Comey's defense team, that the president is simply seeking out a political rival for retribution. Letitia James has made a similar argument. They're going to come to a crescendo Thursday, when, in a federal court in Alexandria, Virginia, they will join efforts to argue their cases should be dismissed. High stakes matter on Thursday.
