The ICJ recalled that Israel must not use starvation of civilians as a method of warfare and that restrictions on essential humanitarian aid directly violate its legal responsibilities. The decision follows a period during which Israel blocked aid to Gaza and forced UNHRA to cease operations after allegations against some of its employees.

As an occupying power, Israel has obligation under international human rights law to respect, protect, and fulfill the human rights of the population of the occupied Palestinian territory. Restrictions on the provision of humanitarian aid that is indispensable for the well-being and dignity of the Palestinian population directly implicate these obligations. Israel had been blocking humanitarian aid to the Gaza Strip for months and forced UNHRA to end its work in the region after accusing some of its employees of taking part in the Hamas attacks of 7 October 2023.
