The ICC issued arrest warrants for Kony and other commanders in 2005. The current hearing is viewed as a potential precedent for future cases involving suspects not in custody.

Kony faces dozens of counts of crimes against humanity and war crimes, including murder, sexual enslavement and rape, for allegedly leading the brutal Lord's Resistance Army that terrorised northern Uganda. Kony founded the extremist Christian rebel group in 1987. It went on to abduct, mutilate and kill thousands of civilians in northern Uganda and across Central and East Africa. In 2005, the ICC issued arrest warrants against Kony and other top commanders. Tuesday's hearing is seen as a test case for other proceedings where the suspect is not in custody, such as Israeli Prime Minister Benjamin Netanyahu and Russia's Vladimir Putin.
