Local leaders have challenged the move in court, calling it unprecedented and unnecessary, and warning it could escalate tensions. Testimony from a local police commander indicated that current protests are less violent than those in 2020, and most recent demonstrations have been largely peaceful. While federal officials cite increased attacks on immigration officers, local officials dispute the characterization of Portland as a 'war zone' and question the justification for deploying the National Guard.

Breaking down dispute over National Guard deployment in Portland

We begin tonight with the trial in Portland, Oregon that will decide whether President Trump can deploy the National Guard there. Portland has seen months of protests since the Trump administration began its crackdown on illegal immigration, but the deployment of hundreds of National Guard troops has been blocked by the courts. CBS Immigration reporter Camilo Montoya Galvez joins me now. So Camilo, take us through the two arguments, one on each side. Sure. So the Trump administration, Maurice, and the president have argued that the National Guard is needed in Portland to protect an immigration and customs enforcement facility there that has been at the center of protests over the president's escalating crackdown on illegal immigration. As you underscore, so far that move has been blocked by the courts because of a lawsuit filed by local leaders who say that move to deploy the National Guard would be unprecedented, unwarranted, unnecessary, and would only further inflame tensions in local communities in Oregon. And today we heard from a local police commander who said that the protests in Portland in 2020, five years ago, were much more violent in nature and disruptive than what we're seeing today. He said, and I quote, it was just an entirely different level of disorder back in 2020 compared to today. He also questioned whether federal agents had sufficient justification and grounds to deploy chemical agents to tear gas against protesters outside of this facility. We saw that on full display when I was there earlier in October, because he's saying that most of the protesters were, again, largely peaceful. The Trump administration would argue that police locally has failed to intervene when the protesters have turned violent in certain instances, and that there has been a sharp increase in attacks faced by immigration officers across the country. Now, the president's been really vocal about calling Portland a war zone. He says it over and over again. You were just there, as you say. What did you see? Well, we traveled there during the No Kings demonstrations across the country, and we did see hundreds of protesters gather outside of this ICE facility in Portland, but they were, for the most part, peaceful, dancing to music in many occasions. There was one particularly tense situation when federal agents had to deploy tear gas to disperse the crowd away from the entrance of that ICE facility. But beyond that, we did not see any large-scale violence. We did see, during a ride-along with ICE, that there was one attempted interference with an ICE operation, so multiple things can be true. ICE is facing an increase in attacks against agents and cases of people trying to interfere with their operations, but local leaders will say that there is no war zone or justification to deploy the National Guard in Portland.
