A Washington, D.C. jury has found David Walsh-Kaufman, a participant in the January 6 Capitol riot, liable for assault and battery against police officer Jeff Smith. The jury ordered Walsh-Kaufman to pay $500,000 to Erin Smith, the officer’s widow, after determining that Walsh-Kaufman’s actions during the riot contributed to injuries suffered by Jeff Smith, who died by suicide days later.

Erin Smith has since become an advocate for recognizing police deaths by suicide as line-of-duty deaths, successfully lobbying Congress for legislative change. She is also seeking to have her husband’s name added to the National Law Enforcement Officers Memorial. Walsh-Kaufman continues to deny the allegations despite the jury’s verdict.

Widow of Jan. 6 officer relieved after jury orders rioter to pay

Half a year after the president's pardons of those convicted as part of the attack on the U.S. Capitol on January 6th, a Washington, D.C., jury has once again ruled against one of the participants on that day. The jury has ordered a convicted rioter to pay a half a million dollars to the widow of a fallen January 6th officer. Aaron Smith, who won the verdict, spoke exclusively with Justice Correspondent Scott McFarlane. Good evening, Scott. Yeah, John, the mass pardons of those 1,500-plus U.S. Capitol rioters really reopened some wounds here for the police victims, for the members of Congress who ran to escape, and for Aaron Smith, whose husband, a police officer, died by suicide a week and a half after the attack. On January 6th, Aaron Smith's husband, Jeff, was one of the police officers beaten and injured, concussed, traumatized, and changed, she says. You were always confident January 6th caused this. Yes. So the man that left on January 6th was not the man that came home in the early hours of January 7th. He was a different person. His personality changed. His demeanor changed. He was there, but the man that I knew was not in the same body. Rioter David Walsh-Kaufman pleaded guilty in his case and acknowledged scuffling with police. Footage obtained by CBS News, Walsh-Kaufman can be seen here on Jeff Smith's body cam. Aaron Smith sued Walsh-Kaufman for assault and battery, alleging he struck the blows that injured her husband. Last month, after a lengthy trial and two hours of deliberation, the jury found Walsh-Kaufman liable and awarded Smith a half million dollars. It felt like a relief, a relief that all the fighting was worth it. Everything that I had done was worth it. And it proves that he was injured. After her husband's death, Smith became a reluctant but impactful advocate. She successfully lobbied Congress to pass law to allow some police deaths by suicide to be designated an official line-of-duty death. And now she's pressing the National Law Enforcement Officers Memorial in Washington to add Jeff Smith's name to its wall and to its honorary ceremony next May, and to open eligibility for others for whom it's been officially determined that they died by suicide because of injuries on the job. Getting his name on there is not just for me. It's also for his family, his friends, his partner, the people at the Metropolitan Police Department, his colleagues. And it's also for other officers who have died by suicide. In a statement to CBS News, David Walsh-Kaufman called the lawsuit and the verdict, quote, For a crime that never happened, he continues to deny the allegations that were made, John, in his criminal case.
