A federal judge has dismissed a central claim in a lawsuit regarding detainee rights at the 'Alligator Alcatraz' facility in Florida. The dismissed claim alleged that detainees' constitutional rights were violated due to the lack of an on-site immigration court. The judge found the claim moot after the Trump administration designated another ICE facility's immigration court to oversee these cases.

However, the lawsuit will continue on the issue of whether detainees are being denied confidential, in-person legal consultations. Separately, another lawsuit challenges the facility on environmental grounds, with Native American and environmental groups alleging harm to the Everglades and wildlife. Florida maintains that the state-run facility is not subject to federal environmental laws, and a ruling on this matter is expected soon.

Judge dismisses part of lawsuit against "Alligator Alcatraz"

Joining me now is CBS News immigration and politics reporter Camilo Montoya-Gavez. So Camilo, explain the judge's reasoning in dismissing one of the key elements in this case. Good morning, Vlad. As you underscored, one of the key arguments in this lawsuit regarding due process for detainees at this Florida Alligator Alcatraz facility in the Everglades centered on the question of whether or not their constitutional rights were being violated because the Trump administration had not set up an immigration court inside of this facility to adjudicate and review the claims of people who want to challenge deportation. Typically in ICE detention facilities, which of course are overseen by the federal government, Vlad, there's an immigration courthouse inside those sites that can review the cases of people in detention who, again, want to fight their deportation on legal grounds. But this is a state-run facility overseen by Florida that does not have that immigration courthouse. But the judge found that that claim is now moot because over the weekend the Trump administration said it would designate an immigration court at another detention center overseen by ICE in Florida as the immigration court that will oversee the cases of people who are held at this state-run facility in the Everglades known as Alligator Alcatraz. Importantly, another part of the lawsuit will proceed, and that is around whether or not the detainee's constitutional rights are being violated because they're not getting access to confidential in-person legal consultation periods and access to that consultation, Vlad. So that part of the lawsuit will continue. So what happens next in this case, and what about the environmental concerns that are being raised? That's an excellent question, Vlad, because this is only one of two major legal challenges against this Florida facility. There's also a lawsuit in Florida regarding environmental concerns, and a Native American tribe and a group of environmental groups say that this facility is hurting and jeopardizing the environment in the Everglades and the wildlife, and it is also circumventing federal laws that actually require environmental reviews before any major construction project. Florida, on the other hand, says that because this is a state-run facility, it is not subject to those federal environmental laws. The judge in this case could issue a ruling on that lawsuit as soon as this week, Vlad. Wow. All right, Camilo Montoya-Galvez, thank you.
