President Trump has threatened to invoke the Insurrection Act, which would allow him to deploy the military to Minneapolis, following an incident where an ICE agent shot a man during an attack. The suggestion comes amid continued unrest in Minneapolis, with federal officials citing violence against agents and property as obstacles to enforcing federal law.

Legal experts and former ICE officials have expressed concerns about the escalation and the lack of tactical training among ICE agents compared to other federal agencies. The Insurrection Act has not been used in over three decades, with the last instance being the 1992 Los Angeles riots, and President Trump has previously floated the idea during past periods of civil unrest but has not acted on it.

President Trump's threatened to invoke the Insurrection Act. That would give him the power to send the military into Minneapolis. The president made that decision or suggestion a day after federal officials say an ICE agent shot a man in Minneapolis while he was being attacked. Fox 4's Sean Rabb joins us now with more. And just a suggestion, not a decision, Sean. Right, not a decision yet. He's floating the idea out there. It's been 33 years since any president has invoked the Insurrection Act in the country and since it became federal law early 1800s it's only been used 30 times by 15 presidents. We spoke today to Dallas attorney who was part of ICE for some eight years. He says he's troubled by what he sees in Minnesota. A wild Wednesday night in Minneapolis, an immigration officer attacked by a group with a shovel and broom handle as he and others tried to make an arrest shot and wounded one of those attackers. Federal officers fired tear gas into the crowd that responded throwing rocks, shooting fireworks. It's escalated to a point I believe that is you know beyond defensible. For eight years Dallas attorney Dan Jividen was deputy chief counsel for ICE Dallas. They have never had the type of tactical training program and requirements that again your real law enforcement agencies have like the ATF, DEA, etc. Why? Because these particular, in particular the ICE ERO agents, the ones that are out there in CBP, I mean they're supposed to be doing administrative arrests. Jividen says law enforcement 101 is to de-escalate not turn up tensions. There's a reason you can't go into a crowd of movie theater and yell fire, right? Because what's gonna happen? But when you jump out of cars in masks that aren't identified with AR-15s pointed at everybody, what do you think it's gonna cause? Thursday turmoil continued in Minneapolis streets. President Donald Trump threatening to invoke the Insurrection Act. That allows the president to deploy the military to suppress insurrections, enforce federal laws, or protect civil rights when local authorities can't or won't. The cases involving the use of federal marshals and federal troops to enforce desegregation decrees is a little more in tune with the specifics of these statutes. There's a specific federal law and not having trouble enforcing it otherwise. The violence against agents, vandalism of vehicles, federal property, the Trump administration says those actions are preventing ICE agents from carrying out federal law. 1992, following the acquittal of police officers in the beating of Rodney King, was the last time the Insurrection Act was invoked to quell widespread rioting in Los Angeles. The Rodney King example is a little bit looser. It's a little bit different from how it's been cited in the past and of course it's the one that's most relevant to the current situation and the one that President Trump is most likely to cite as precedent. Of course, in 1992 there was widespread violence in Los Angeles. Over several days, 60 people died. Another 2,000 folks were injured or wounded. There were 4,000 fires set, destroying businesses and homes and so a big difference from what we're seeing in Minneapolis. The president has floated this idea before going all the way back to 2020 in his first administration when there was widespread riots and protests after the George Floyd murder, but he has never actually invoked the Insurrection Act. We'll see what happens in the days ahead and see what happens in Minnesota tonight.
