During a court hearing in Provo, Utah, Tyler Robinson's defense team requested the removal of the Utah County Attorney's Office from the prosecution of the Charlie Kirk shooting case. The defense argued a conflict of interest exists because a prosecutor's adult child was present at the event where Kirk was killed, raising concerns about impartiality and the pursuit of the death penalty.

The Utah County Attorney's Office denied any conflict, stating decisions are based solely on evidence and that the prosecutor's child is not a material witness or victim. The judge chose to continue with the current prosecution for the time being, and unresolved issues will be addressed at the next hearing scheduled for February 3.

I was in the courtroom for the nearly four and a half hour hearing and Tyler Robinson mostly just sat in a seat and listened looking pretty stoic but he did look back at his family a couple times who was sitting on the front row but today the defense didn't even get through one full witness and most of the time was spent with the defense arguing for a whole new hearing and a whole new prosecution. The judge ultimately cited hours into this hearing that the court was going to move forward for today. The hearing centers around a claim that there's a conflict of interest at the Utah County Attorney's Office. Lawyers for Robinson argue one of the prosecutor's kids who is an adult was at the Turning Point USA event when Charlie Kirk was shot and killed back in September. The defense says prosecutors can't stay impartial and should be removed. According to an affidavit, Robinson argues in the motion the state could be making emotional decisions including the decision to seek the death penalty. The Utah County Attorney's Office says that's not the case at all and all decisions have been made based on evidence and the prosecutor has no personal conflict of interest because his child is not a material witness or victim in the case. Utah County Attorney's Office are both litigating as representatives of the state in the prosecution and essentially defending their own propriety of proceeding in this prosecution is problematic. I think that the motion or that the request that the defense has made assumes that a conflict does exist and that there's an inability of the party who has been accused of a conflict to defend themselves and I just don't think that that's true. And to answer your question off the top Ellen, a lot of legal analysts on Fox say the whole prosecution most likely will not be thrown out but the defense is trying anything they can to avoid the death penalty. Now today the only witness we heard from was Jeff Gray, an attorney for Utah County and what wasn't accomplished in today's hearing will be moved to Robinson's next scheduled hearing on February 3rd.
