Joining us now for more on this is former federal prosecutor Joseph Marino along with attorney and legal Analyst Jonna Spillboard great to have you both here John. I'll start with you. What do you make of this? Investigation will anything actually come of it? I mean clearly she took President Trump through the ringer with these cases Do you think that this is payback? No, I don't think it's payback I think it's payment and the difference is we're not the the DOJ here is not looking for some sort of retribution You know, unlike what Letitia James did when she went after Donald Trump in that civil fraud case. She wasn't Uncovering some civil fraud she was creating a case for civil fraud There's a there's a big difference there What's happening now is that this DOJ has pulled back the curtain to see? What she has done in connection with how she well two things how she Applied for her own mortgages, which are two mortgages Which is going to be problematic for her and why the civil fraud case against Donald Trump was born in the first place You know you show that clip where she's smiling with a constituent and she's proclaiming that she's gonna be a pain Yeah, and in Donald Trump's derriere. How is that a pursuit of justice? That sounds far more personal than it sounds a pursuit of justice. Show me the man I'll find the crime isn't that the expression goes, but I want to get to this Joseph, you know She's she's being accused of obviously what's going on with her mortgage, but she's also being investigated for a bank fraud wire fraud She's also has said a lot about the you know, how she used the her Justice Department But do you think she covered her tracks well enough? Do you think that now if they get to these documents or if they have to turn over evidence will they find anything Joseph? Well, I have to think that she never Expected to be in this position that either Donald Trump would be in prison based on the other cases He was facing or he at least would be exiled and not back in the White House. So I have to think that now When you say covering her tracks She better darn well hope that she did because these are the kind of things that are not that difficult to prove either she misstated or she Misappropriated the the mortgages on her properties or she did it And so I think the number one question will be is there a statute of limitations problem, right? Have enough years gone by where she can get away with it basically without liability So whether they find something or if that's chargeable or not I do think the investigation itself by the grand jury will be very damaging not just in terms of what she Herself did but I think in terms of internal emails correspondence Testimony from people within her office of the Attorney General of New York going after Donald Trump So I think it will be very instructive regardless of whether criminal charges against Letitia James are ultimately fine That's the thing too I mean President Trump went through so many of these things where he got publicly smeared in and these these cases and maybe you're right That's what's gonna happen next, but I want to switch gears because there's another well There's a Democrat trying to get a leg up in the real estate market You might say California Senator Adam Schiff also being investigated by the DOJ for mortgage fraud Among some other false statements. He had a Maryland property there that he called maybe is well It was his primary residence. He was a little fudgy here with the paperwork, but I want to John Do you think that the hammer could come down on him? I mean this guy he's a lawyer How did he not know and was he just trying to skirt the system here Same stuff different day. I mean look you can't lie on a mortgage application I don't care who you are and it's gonna come to pass if you get caught that you are committing a federal crime You know, they say that the the content of a person's character is what you do when you think nobody is looking Well Adam Schiff Letitia James They checked the wrong boxes on their mortgage applications when they thought nobody was looking but guess what we looked So this is going to be a problem because I agree these types of crimes are not hard to prove Why because there's a paper trail there's you know You've signed under penalty of perjury when you make a federal application for anything Just show me the documents and that should be enough Given both of these cases, I mean, we'll wait to see how they play out in court But Joseph, do you think that some point someone's going to jail? Hard to say and I understand that people realize what Donald Trump went through and it was a grotesque Abuse of the justice system in New York and New York City and elsewhere Whether or not people go to jail, you know, look they might escape this due to the passage of time alone But I think people realize whether it's Letitia James being so hypocritical and going after Trump or Adam Schiff who we know Darn, well knew that there was no Russia collusion issue and then spent two years on cable television Going about it anyway, so I understand the desire to hold these individuals accountable It may or may not be through criminal charges But I do think when they get to the bottom of these and they air the facts I think these two individuals are not gonna look too good.
