OpenAI omitted this distinction in its proposal, prompting responses from users on social media. 

Amidst ongoing discussions, OpenAI and other companies like Google are lobbying for policies that would ease regulations on learning from copyrighted materials. This stance is bold, considering current legal disputes with media outlets. The debate equates the AI industry's growth with national security, opening discussions about data regulation and export control reforms. Meanwhile, major tech companies face regulatory challenges, with the DOJ targeting Google's monopoly and the FTC continuing actions against Amazon.

Our dear Durbosa has more in today's Tech Check. Morning, Dee. Hey, good morning, Carl. So, we are starting to get a better picture of how the Trump administration will regulate tech. And so far, it seems like big tech is still out, but AI could get a break, especially as China makes huge strides in the race. Now, it's something the OpenAI team is no doubt tracking closer than anyone else. And so this new policy proposal, it's seeking to use that nuance as an edge. The 15-page proposal, it begins with a quote from President Trump just earlier this year. It is the policy of the United States to sustain and enhance America's global dominance. It then admits that DeepSeek shows that our lead is not wide and is narrowing. The paper then argues that DeepSeek and other PRC-produced models should be banned to protect privacy and security risks. Now, all of this comes amid reports that DeepSeek is rushing to release its next generation R2 model. And reminder for our audience, there's a distinction here. DeepSeek the app and DeepSeek the open source model, which are hosted by Microsoft, Amazon, Perplexity, many other American companies who can strip out the censorship and host it themselves because it is open source. Now, OpenAI doesn't make that distinction in the paper, a fact that many Twitter users or ex-users called out online. Now, there's other signs, too, that our American AI players are perhaps gauging the Trump administration, seeing how far they will go to protect and, quote, strengthen America's lead globally. OpenAI and Google, they're asking the administration to make it easier for AI companies to learn from copyrighted material. That's a bold ask, given ongoing lawsuits from The New York Times and other media outlets and groups. But by likening the AI race to a high-stakes arms race, deeply important to our national security, there seems to be this opening for AI players to ask for everything from looser data regulations to favorable export controls. All the while, the incumbents, that's megacap tech, they continue to draw regulatory scrutiny. The DOJ still wants Google broken up. And this week, the FTC said it will indeed pursue its case against Amazon. Even there, there's nuance in those battles, though, that could, again, advantage little tech. Now, in the DOJ's latest filing, guys, it said it would let Google keep its investments in AI startups like Anthropic, perhaps opening the way for more of these investment stakes, maybe even M&A. But I will say, not everyone in this space, some of the people I talk to, too, thinks that the American AI industry needs this kind of preferential treatment or protection. The idea of out-build, not out-law, out-innovate here is what they argue for. And online, as I mentioned, there's been blowback to the OpenAI proposal, users accusing Altman and the startup of being out-innovated and making up for it through policies that some may argue go too far, guys.
