A federal judge has ordered the Justice Department to provide all grand jury materials to the defense team of former FBI Director James Comey, who faces charges of obstruction and lying to Congress. The judge described a 'disturbing pattern of profound investigative missteps' that could potentially lead to the case's dismissal.

The order, considered an 'extraordinary remedy,' is currently on hold while the government is given time to respond. Concerns include possible misinformation given to the grand jury by the U.S. attorney and irregularities in the proceedings, prompting the judge to emphasize the rare and serious nature of the situation.

In a rarely seen move, a federal judge has ordered the Justice Department to turn over all grand jury materials to the defense team for former FBI Director James Comey. In a scathing ruling, the judge wrote there was, quote, a disturbing pattern of profound investigative missteps that may require dismissing the case. Comey has pleaded not guilty to obstruction and lying to Congress charges. CBS News legal reporter Katrina Kauffman is following this case and joins us now to discuss. Katrina, I understand there's some new information on this case as well. What's the latest? Errol, so basically there are two judges with this case. One is overseeing the case and the other one has been dealing with some discovery issues. He's the one who made this decision about turning over the grand jury materials to James Comey. Now, the judge overseeing the case has paused this for now. He wants the government to have an opportunity to respond. They're supposed to respond by Wednesday. So for now, James Comey will not be getting these grand jury materials. How unusual is it for a judge to issue the kind of statement we just read and order this type of ruling to allow the grand jury secrets effectively to be seen by the other side? Errol, this is extremely unusual. The judge even wrote here that it's an extraordinary remedy, but he does believe there may have been missteps in that grand jury room. And this is such a sancted process. He wants to make sure that the integrity of the grand jury proceedings is maintained. He's worried that Lindsey Halligan, the U.S. attorney who brought this case, may have told the grand jury things that just were not true about the criminal process, such as that James Comey couldn't not testify at his own trial. You do have the Fifth Amendment right not to testify at your trial. He also believes she may have told them that they could rely on believing that there's evidence the government would present at the trial that wasn't in the grand jury room. There are some issues with the timeline here. Just a number of things that made him concerned about what happened in that room and making sure that the accused has the right to review those materials. This is so rare, though, Errol. It's hard to emphasize. Yeah. Viewers should really take a close look at the judge's statement because it really explains how unusual the judge believes everything has been so far.
