The ABC has already been ordered to pay Antoinette Latouf $70,000, but today's hearing was about how much it should pay as a penalty for breaching the Fair Work Act. I haven't had a personal apology, a personal public apology, and all I want is for an ABC that is fair and that acts with integrity. Latouf was terminated three days into her radio contract after she shared a post about starvation in Gaza on Instagram in 2023. Her lawyers say the ABC caved to pressure from lobbyists. The Federal Court is now assessing what sting or level of sting is needed to ensure this organisation takes appropriate steps to make sure it is not panicked to deal with its employees in the way it dealt with Ms Latouf again. Latouf's legal team has suggested a penalty of more than $300,000, but the ABC says as little as $37,000 is appropriate, which Latouf's lawyers argued is just .0038% of the broadcaster's billion dollar budget, calling it an infinitesimally small amount of money. I am surprised and disappointed that despite the ABC wasting $2 million of taxpayer money, that they still believe that the penalty should be as little as $36,000. The ABC's chief people officer was questioned about the national broadcaster's regret, which Latouf's lawyers labelled as performative. ABC's lawyers say it wasn't a carefully planned act, but done under stress due to it being a controversial issue. They say it is unlikely to ever be repeated.
