The attorney representing Gomez Da Silva said their client has no criminal history and entered the country lawfully using a B2 visa in 2013. This allows foreign nationals to visit the United States for tourism or visiting family and friends. Gomez Da Silva eventually received a student visa, which has since lapsed, according to his attorney. It is unclear when it expired. His attorney says she expects Gomez Da Silva to be eligible for asylum and that he intends to apply. The community launched a fundraiser to help Gomez Da Silva with his legal and court expenses, which has raised nearly $40,000.
