The legal battle over Texas' controversial immigration law expanding the powers of local law enforcement over migrants was back in court Wednesday. The U.S. 5th Circuit Court of Appeals heard oral arguments to consider whether the law Gov. Greg Abbott supported and signed is unconstitutional.

The controversy surrounding Texas' immigration law, known as SB4, which expands the powers of local law enforcement regarding migrants, has recently been revisited in court. The U.S. 5th Circuit Court of Appeals engaged in a session to hear oral arguments. The court is deliberating whether the law, supported and signed by Governor Greg Abbott, violates the constitution.



Is Texas immigration law SB4 unconstitutional?

The law known as SB4 has been blocked from taking effect while its constitutionality is argued in court. It makes illegal entry into the U.S. a state crime and gives local law enforcement the power to arrest anyone suspected of that. At a hearing in the Fifth Circuit Court of Appeals, Texas Solicitor General Aaron Nielsen insisted the law does not interfere with federal authority in immigration. What Texas has done here is they have looked at the Supreme Court's precedent and they have tried to develop a statute that goes up to the line of Supreme Court precedent that allows Texas to protect the border. Now, to be fair, maybe Texas went too far and that's the question this court is going to have to decide. He admits that Texas may have gone too far. Texas State Representative Armando Wally fought against the law. It hurts us personally, bro. It hurts us. This moment where Wally spoke out before the bill passed late 2023 became viral on social media. He says SB4 will lead to racial profiling against Latinos. Texas itself has a long, complicated history in its treatment of its people of color.
