A lawsuit has been filed against the Department of Homeland Security by six individuals in Minnesota, supported by the ACLU and other legal organizations. The suit alleges that ICE agents entered homes without judicial warrants during immigration enforcement actions, citing an internal memo that purportedly authorized such conduct.

The plaintiffs argue this practice violates the Fourth Amendment, as administrative warrants are not signed by judges. The case includes testimony from affected families and may proceed to the Supreme Court. Homeland Security officials have not yet responded to requests for comment.

Homeland Security sued over warrantless raids

It just seems unthinkable that the government would try and have this kind of power grab. New tonight, a half dozen people are suing the Homeland Security Department over warrantless raids. The lawsuit claims that ICE directed agents to go into homes without a judge's approval during the immigration crackdown here. Fox 9's Mike Manzoni went through the court filings tonight. And Mike, this case could go all the way to the Supreme Court. Randy, that is what one of the attorneys on the case told me tonight. It all centers on an alleged internal memo from last year that the suit claims instructed agents to raid homes without a judicial warrant. The lawsuit says that policy is unconstitutional. This North Minneapolis ICE raid in January is now part of a lawsuit against the Homeland Security Department. That is exactly the type of conduct that the framers of the Fourth Amendment did not want. The ACLU of Minnesota and other legal groups are suing DHS on behalf of six Twin Cities immigrants and U.S. citizens. ACLU attorney Terry Nelson claims that a secret memo instructed ICE agents to go into homes with only an administrative warrant, which is not the same as a warrant signed by a judge. They are essentially saying that because people have a final order of removal, that the existence of a final order of removal somehow gives them a different authority than what the Fourth Amendment requires. The officers walked up to my door and started ramming the door. Show the warrant first! Tayana Gibson-Brown testified on Capitol Hill in February about what happened when federal agents stormed into her Minneapolis home in January to arrest her husband. Ten officers that were all armed were standing in front of me and my family. Words can never be sufficient for me to portray what sorts of horror we felt in this moment. And we reached out to Homeland Security officials tonight for comment, but have not heard back yet. Randy?
