Concurrently, it has been indicated that there will be an opportunity for the state’s electorate to vote on this matter, potentially to overturn the existing restrictions, in an upcoming November ballot.

Florida's Republican-appointed justices have ruled in a 6-1 decision that the state's constitution does not protect access to abortions. Based on our analysis, finding no clear right to abortion embodied within the privacy clause, Planned Parenthood cannot overcome the presumption of constitutionality and is unable to demonstrate beyond a reasonable doubt that the 15-week ban is unconstitutional. Before the ruling, Florida was a relatively safe haven for abortion in the American South as neighboring states were more restrictive. Now, not only is the 15-week abortion limit upheld, but a much stricter 6-week limit will take effect within a month. Many women do not realize they are pregnant at 6 weeks. But the Florida Supreme Court will also let voters decide in November if abortion rights should be enshrined in the state constitution. Democrats have been working to put abortion rights questions on the ballot as voters in seven states have sided with abortion rights supporters in the last two years. This marks a major change in tactic for the party. Less than a decade ago, Democrats sought to be a big tent party with no official platform on abortion rights. Democrats really didn't want to talk about abortion. They didn't want to speak the word. And this has completely changed now because Democrats recognize that with, largely because of these ballot measures, there's going to be wind behind their sails because of the Dobbs ruling. And anybody who wants to come out and vote for an abortion rights measure is likely going to be supporting Democratic candidates. President Joe Biden has made abortion a centerpiece of his re-election campaign in a bid to increase turnout. Nonetheless, he said recently that he opposes abortion on demand due to his Catholic faith.
